Terms and Conditions for Pay in 3

This credit agreement is between,

Hit Home Limited a company registered in England and Wales under registered number 11443812 whose registered office is at 16 City Business Centre Suite 233, Hyde Street, Winchester, England, SO23 7TA (“We”, “Us” or “Our”); and

You – Anyone who has paid for a home survey using Pay in 3 instalments through HitHome (“You”, “Your” or “Yourself”).
This agreement is a fixed-sum credit agreement between you and us.

 

Pay in 3 is classed as a credit product and it is at our discretion as to whether or not we agree to enter into a credit agreement with you.
Before proceeding with Pay in 3 it is important you read and carefully consider this agreement. By using our Pay in 3 service you confirm that you have read, understood and agree to this agreement.

It is important that you are able to keep up with your repayments and you must not enter into this agreement unless you are able to afford the future payments.

By using Pay in 3 and by entering into this agreement you expressly agree that the agreement commences immediately and not after the expiration of the 14 day ‘cooling-off period’ provided by The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and/or the Consumer Rights Act 2015.

If you want to cancel your survey after booking through Hit Home, you will need to cancel it directly with the surveyor, in line with the surveyor’s cancellation policy. HitHome are not involved in the cancellation process.

 

 

What is Pay in 3?

Pay in 3 allows you to pay for your home survey by splitting the survey cost into three interest-free instalments.

Not all of the surveyors registered with Hit Home offer Pay in 3, so the option to pay in 3 may not be available to all user of Hit Home.

When you confirm your survey booking there may be an option to Pay in 3. If you select this option we will contact you and provide you with an invoice which will split the payments into three monthly payments.

The first payment is due immediately, the second payment is due a month later and the third payment is due a month after the second payment.

The survey will not be booked until the first payment has been made.

There is no interest, fees or additional charges when you pay via Pay in 3.

You can repay any amount you owe in full, at any time, without incurring any additional fees of charges.

In order to cancel your survey you must cancel in line with the surveyor’s cancellation policy and any money you have already paid will only be refundable if the survey is cancelled in line with the surveyor’s cancellation policy.

 

 

Who Can Use Pay in 3?

In order to use Pay in 3 you must be a resident of the UK.

Pay in 3 is only available to people buying houses in England or Wales and is not currently available to people buying houses in Scotland or Northern Ireland.

In order to use Pay in 3 you must be over 18 years of age.

Pay in 3 is not available for any surveys which cost over £1,500 and it is at our discretion, on a case by case basis, whether or not we choose to offer the option to Pay in 3.

We may carry out a ‘soft credit check’ on you at a credit reference agency. If this is done it will not affect you credit score. However, we may report information to credit reference agencies about payments you make, payments you fail to make on time, or payments you fail to make.

We reserve the right, at our sole discretion, to refuse Pay in 3 to you, for any reason.

 

 

Cancelling your survey

If you want to cancel your survey after booking through Hit Home, you will need to cancel it directly with the surveyor, in line with the surveyor’s cancellation policy. HitHome are not involved in the cancellation process.

If you want to cancel the survey you will need to provide the surveyor with sufficient notice prior to the survey being carried out. The required notice period required will varying between surveying firms and at the very least you would need to give the surveyor 2 working days’ notice (48 working hours) before the survey is due to be carried out. With some surveyor you may need to give more notice, this is why it is essential you confirm the cancellation policy directly with your surveyor when you book the survey.

If the surveyor’s cancellation policy is not provided to you by the surveyor it is essential you contact the surveyor to confirm their cancellation policy.

Once the survey has passed its notice period, you will lose your right to cancel during the 14-day ‘cooling-off’ period provided by The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (‘the Regulations’) and/or the Consumer Rights Act 2015.

The process of cancelling the survey will be different for each surveyor and it is important you confirm with your surveyor how to cancel the survey should you need to.

If you do not cancel the survey in line with the surveyor’s cancellation policy then there is no guarantee that the survey will be cancelled, and a refund will not be given. It is therefore important you ensure you give the required notice to the surveyor if you want to cancel your survey.

 

 

Failure to Make Payment

Borrowing more than you can afford to borrow, or making payments late may negatively impact your financial status and your ability to obtain credit from us, or any other lenders in the future.

The survey will not be booked until the first payment has been received.

In the event that we do not receive the second or third payments we may contact the surveyor to inform them that we have not yet received that payment, and this could delay, or prevent the survey from being carried out or provided to you.

Surveys may be cancelled, delayed or withheld if payments are missed or not made.

If you do not pay your instalments on time it might mean that you are unable to use Our Pay in 3 option in the future.

If payments are missed or unpaid we might contact you to ask you to make payment for the outstanding amount directly to us or we may use a debt collection agency to collect the money for us. A debt collection agency would be an FCA regulated company we use to recover money that is due to us and overdue. You will always be informed if we have to use a debt collection agency.

We do not charge late fees for late payments.

 

 

Payment Refunds

If you cancel the survey in line with the surveyor’s cancellation procedure and a refund is due to you for the payments you have already made then the payments will be refunded to you by us.

We will not return any payments until we have received confirmation from the surveyor that the survey has been cancelled in line with their cancellation policy and that a refund is due.

Once the surveyor has confirmed that the survey has been cancelled and a refund is due we will cancel any outstanding payments and refund any amounts you have already paid to us. Please be aware that the time it takes to arrange a refund will vary.

 

 

Paying Early

If you decide to pay your outstanding instalments early you can do this by requesting our bank account details to arrange for a bank transfer direct to our account.

If you pay off your outstanding instalments early no further payments will be due and there are no additional charges of fees for paying early.

 

Privacy

We will use your personal date to identify you, carry out credit assessments and credit reporting to credit reference agencies.

We may share your data with partners such as credit reference bureaus which could be located outside of the UK.

By using our Pay in 3 service you confirm that you have read, understood and agree to the Privacy Policy.

 

Complaints

You can make a complaint directly to us by emailing your complaint to hello@hithome.co.uk.

Unregulated products like Pay in 3 are not subject to Financial Ombudsman Service’s jurisdiction, you therefore cannot make a complaint to the Financial Ombudsman Service about Pay in 3.

 

Right to Transfer

This credit agreement is between you and us. You cannot transfer your rights or obligations to anyone else unless you first obtain permission from us in writing to do so.

We reserve the right to transfer these terms, condition and any rights or obligation you have under them, at any time, without your consent, unless such transferring would harm your rights and responsibilities. This means we have the right to transfer this credit agreement to another provider without asking your permission.

 

Termination

This agreement will terminate automatically when the last payment has been received.

 

Regulation

Hit Home Limited are not regulated by the Financial Conduct Authority and we do not carry out any regulated consumer credit activities.

Our Pay in 3 agreement is not regulated by the Financial Conduct Authority.

Pay in 3 falls under the exemptions set out in section 60F of The Financial Services and Markets Act (Regulated Activities) Order 2001. This means you may not benefit from the protections provided by the Consumer Credit Act 1974 or by the UK’s consumer credit regime.

 

Other Parties

A person who is not a party to these this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement.

 

Variation

No amendments or variation to these terms and conditions will have any contractual effect unless agreed by, and signed by, the parties in writing.

 

Entire Agreement

These terms and conditions constitute the entire agreement between Us and you in relation to the subject matter of this agreement.

 

Governing Law

These terms and conditions are governed by and construed in accordance with the law of England and Wales. You hereby agree that the courts of England and Wales will have exclusive jurisdiction to decide a dispute involving these terms and conditions, regardless of who initiates proceedings.
